Membership of Committee |
-
The Chief Syariah Judge – who shall be the Chairman;
-
Attorney General or his/her representative;
-
Syarie Public Prosecutor;
-
Two other members nominated by the Majlis; and
-
The Registrar.

Functions of Committee |
-
To organize Sijil Peguam Syarie examination and all other matters related to, including:
- To provide and publish the syllabus for the examination;
- To set a date for the examination;
- To draft or process the questions and examine answer sheets;
- To provide the question paper.

To admit the Syarie Counsel; and
-
To exercise any other functions or duties instructed by the Majlis.

Validity of Syarie Counsel Practising Certificate
|
Every Practising Certificate shall be valid for a year from the date issued. |

Qualifications for admission |
- Muslim
- Malaysian Citizen
- 21 years and above
- Academic
- Has not been adjudicated bankrupt
- Has not been guilty of any syariah and civil criminal

Renewal Guideline |
Every Practising Certificate may be renewed when the committee satisfies that such applicant has paid the fee amounting to RM100.00 and all the procedures and requirements have been observed.

Objection Process |
Any objection rise against the application or admission of Syarie Counsel, shall be forwarded in writting to the Committee Chairman stating the grounds of objection.

|
Complaint Process |
-
Any complaints against a Syarie Counsel on the grounds of professional misconduct shall be lodged to the Committee.

The Court or the Syarie Public Prosecutor may, at any time, refers to the Committte any relevant information regarding misconduct by Syarie Counsel on his/her professional capacity or otherwise which amounts to grave impropriety.

Appeal Process |
An appeal against any decision or order made by the Committee under this rule shall be made to the Majlis either by the complainant or the Syarie Counsel concerned within one month from the date of the order and the Majlis decision is final.

|
Conduct of Syarie Counsel |

The Syarie Counsel shall be subjected to control by the Committee and may, on reasonable cause, be suspended or censured,reprimanded or strucked–off from the Register.

The reasonable cause may prove that the Syarie Counsel:
- Has been convicted of criminal offence;
- Has been charged with breach of trust in discharging his/her professional duties or fraudulent or any conduct which makes him unfit to be a Syarie Counsel;
- Has tendered or gave any gratification to any person for having procured the employment in any legal business of himself or any other Syarie Counsel;
- Has directly or indirectly procured or attempted to procure the employment of himself or any other Syarie Counsel through or by the introduction of any person to whom any remuneration for obtaining such employment has been given by him or agreed or promised to be so given;
- Has accepted employment in any legal business through a tout;
- Allows any clerk or any other unauthorized person to carry on legal business in his name without his direct and immediate control as principal or without proper supervision;
- Carries on by himself, directly or indirectly, of any trade, business or profession which in the opinion of the Committee is incompatible with the legal profession as a Syarie Counsel;
- Has committed a breach of any provision under this rule or any other rules made thereunder the Act which in the opinion of the Committee, requires disciplinary proceeding.

In any other proceeding thereunder the Committee may, as additional facts to the case, take into consideration the Syarie Counsel’s character and previous conduct in making a final decision.
